The present General Conditions of Sale relate to the trade with our customers for the sales and services presented on the site www.itroika.com and, more generally, are applicable to the whole of the commercial documents emitted by our company. Any order implies the preliminary consultation and the acceptance of these General Conditions of Sale, which are accessible constantly by a direct and permanent link on this site. It is understood that the people considered juridically unable to contract within the meaning of articles 1123 and following of the French Civil code, in particular the minors, will have obligatorily to obtain the authorization of their legal representative before any order. The offers of products are valid within the limit of stocks available. 

You can place an order on our site by selecting the articles of your choice, which you will then place in your basket while clicking on the "Buy" button. You can reach your order constantly and rectify the contents of your basket as long as the order is not definitively validated. It is only after confirmation of the exactitude of the provided information that the order is recorded. The order becomes final while clicking on the button "Validate my order". We will acknowledge receipt of your order as soon as possible in the form of an e-mail recapitulating your purchases which will be addressed to you to the electronic address that you provided at the time of the confirmation order. At the time of the seizure of your order, you are in addition informed of the availability of the articles. If we cannot satisfy the whole of the order, we will inform you as soon as possible. You can ask to be warned by e-mail of the availability of the missing article. Only the products available can be ordered, but if, independently of our will, an inalienable article had been suddenly chosen, a notification of unavailability will reach you by e-mail. You will be able to then ask for an article of a quality and an equivalent price or the refunding of the difference. In the event of replacement of the article, you preserve the possibility of returning it to us, the expenses of return being to our load.

The prices are indicated in Euros or Dollars (choose your devise on top of the screen) including all taxes. The postal expenses of delivery are invoicees according to your geographical situation in addition (see "Delivery"). The VAT included is the French VAT into force at the day of the order. The products remain the property of Troika until the complete payment of the price. TROIKA reserves the right not to deliver an order in the event of legitimate reason as defined by the regulation (litigation relative to a former order, abnormal requires of the customer).

The payment is carried out:
- by bank card (VISA and EUROCARD MASTERCARD are accepted).
- by Paypal (free inscription on www.paypal.fr)
- credit transfer.
- Personnal check in France and some countries in EEC (ask us for accuracy), not out of EEC

 

In order to ensure the safety of the payments, the confidential data (16 digits Card Numbers, end date, visual cryptogram) are directly transmitted by encoding SSL on the servers of our bank, "Le Crédit Lyonnais". No data of bank card is in our possession.

We always try to find the best compromise between safety, cost and speed of delivery. The selected support varies according to destination (Metropolitan France, Dom-Tom, the EEC, foreigner). We privilege the safety of transport. All our sendings are carried out with a proof of dépot at the Post office, preferably with a follow-up of routing on line (when this service is available).

- the delivery is started by the reception of the payment. Immediately for the orders regulated by bank card or Paypal, with reception of the funds for the payments by credit transfer, with the cashing on our account for the payments by cheque.
- the sendings are carried out all business days (Monday to Friday) for the orders received and regulated before midday. The orders received after midday will be treated with the first next business day.

- in France: our sendings are carried out either in Colissimo, or Distinguo. In both cases, the delivery period normally noted is of 48h. It arrives sometimes (but seldom), that this time is longer (up to one week), this being exclusively due to internal conditions from the Post office. TROIKA would not be held responsible for these risks independent of its will, and this cannot in no case to constitute a reason for cancellation of order. In the event of time higher than one week as from the date of dépot, the customer can cancel his order and ask for refunding of it, and will have to turn over this order as of his reception, and to his expenses. Required refunding will be carried out with reception of the goods, except in the event of loss proven by the post office, in which case refunding will be carried out as of the determination of the final loss of the initial sending.

You must carefully check the contents of the parcel to its reception and, in the event of damages or of lacks, do not omit to express reservations precise and justified on the receipt of delivery. With defect, you have three (3) days a legal time, not included/understood the public holidays, as from the reception of the parcel to express these reservations by letter registered with notice of receipt directly near the conveyor, in accordance with the article L. 133-3 of the French Commercial law.

If a product does not correspond to your wills, you have a delay of 7 retractation days as from the date of reception of the product for us to turn over it for an exchange or a refunding. To protect your article at the time of transport, it is enough for you to carefully place it in its original packing or a adapted packing (not to use of paper envelope) and to address it to "TROIKA - 2 rue des bouleaux - 95490 Vaureal - France", the expenses and risks of transport being due to the customer. The articles turned over at their initial state and without any transformation will be exchanged or refunded (except personalized model and special creations). The gifts checks not constituting money values, they can neither be refunded nor exchanged.

This is why we offer a satisfied or refunded guarantee throughout 30 days as from the reception of your order, without condition.
Except in the event of nonconformity of the product compared to description on the site www.itroika.com, the return will have to be carried out with your expenses (the return of the goods non in conformity will be carried out to our expenses).

For the objects of use such as the watches, an additional legal guarantee relating to the hidden defects applies:

The legal guarantee gets along within the framework of a normal use. Are excluded from this guarantee, wear and ageing (pile, bracelet of watches, crushing of the hollow meshs, etc) and the losses or break-ins resulting from an accidental circumstance. Independently of the commercial guarantee, you profit from the legal guarantees relating to the defects of conformity of the product (articles L. 211-4 and following of the Code of Consumption) and the crippling defects (under the conditions envisaged in articles 1641 to 1649 of the Civil code), as recalled below: The salesman is held to deliver a good in conformity with the contract and answers of the defects of conformity existing at the time of the delivery. He also answers of the defects of conformity resulting from packing, the instructions of assembly or the installation when this one was put at its load by the contract or was carried out under its responsibility (article L. 211-4 of the French Code of Consumption).

 

To be in conformity with the contract, the good must:
1° - To be clean with the usually awaited use of a similar good and, if necessary: - to correspond to the description given by the salesman and to have qualities that this one presented at the purchaser in the form of sample or of model; - to have qualities until a purchaser can legitimately wait have regard with the public statements made by the salesman, the producer or his representative, in particular in publicity or labelling.
2° - Or to show the characteristics defined by mutual agreement by the parts or to be clean with any special use sought by the purchaser, made available of the salesman and that this last accepted (article L. 211-5 of the Code of Consumption).

 

The action resulting from the defect of conformity is prescribed by two years as from the delivery of the good (article L. 211-12 of the Code of Consumption). The salesman is held of the guarantee at a rate of the hidden defects of the sold thing which make it unsuitable with use for which one intends it or which decrease this use so much that the purchaser would not have acquired it or only one less price would have given any, if he had known them (article 1641 of the French Civil code). The proceedings resulting from the defects rhédibitoires must be brought by the purchaser within two year as from the discovery of vice (article 1648 1st subparagraph of the French Civil code).

The present General Conditions of Sale and the contractual relations y related are controls by the French right. The Official language of this contract is the French language. Any litigation could be carried only to France in front of the courts of competent jurisdiction of the "Val d'Oise", in accordance with the legal provisions common and of the private international law.

The site www.itroika.com and all its elements are protected by the rights of intellectual ownership into force.
They are the exclusive property of TROIKA or its partners.
The use of this site is reserved for a strictly personal use.
Any use, reproduction, exploitation, representation, in all or partly and on some support that it is, at other ends that personal, are prohibited and penally sanctioned, in particular in the counterfeit purpose as well as laws relating to the copyright and the intellectual property.
